THE MONITOR

On May 12, 2021, the United States District Court for the Eastern District of Michigan appointed Neil M. Barofsky of Jenner & Block LLP as the independent Monitor of the UAW, pursuant to the Consent Decree entered into by the United States and the UAW in United States v. International Union, United Automobile, Aerospace, and Agricultural Implement Workers of America, No. 20-cv-13293 (E.D. Mich.).

The UAW Monitor is independent of, and does not represent, the UAW or any of its constituent entities. The Monitor reports only to the United States District Court for the Eastern District of Michigan.

The Monitor’s authority and duties are established by, and set forth in, the Consent Decree. The most recent version of the Consent Decree can be downloaded here.

The UAW Monitor’s website describes the Monitor’s duties, www.uawmonitor.com. The Monitor’s website hosts the Monitor’s reports and other important documents relating to the Monitorship, such as the Rules for the 2022 UAW International Officer Election and 2023 UAW International Officer Run-Off Election (see below).

2022 DIRECT ELECTION OF INTERNATIONAL OFFICERS

The vote count for the 2022 UAW International Officer Election began on Tuesday, November 29, 2022, and was completed at approximately 8:30 p.m. ET on Friday, December 2, 2022. Information regarding unofficial 2022 Election results, including a link to the final vote count, are included here and in the Monitor’s Fourth Status report, available here.

Based on the unofficial 2022 Election results, there will be a 2023 UAW International Officer Run-Off Election (“Run-Off Election”), with the following offices to be filled: one (1) International President, one (1) International Vice President, and one (1) Region 9 Director. Since there will be a Run-Off Election, the individuals currently in those roles will remain in place until the run-off elections are complete and a second swearing-in is held. More information regarding the Run-Off Election and 2021 Referendum is included below.

2023 RUN-OFF ELECTION OF INTERNATIONAL OFFICERS

On December 14, 2022, the Monitor issued the Official Rules for the 2023 UAW International Officer Run-Off Election (the “Run-Off Rules”) to govern the races for International President, International Vice President, and Region 9 Director that comprise the Run-Off Election. The Run-Off Rules are available here (English-language version) and here (Spanish-language version). These Run-Off Rules generally mirror and/or incorporate the Official Rules for the 2022 UAW International Officer Election (the “Election Rules”) and the other rules issued by the Monitor in advance of the 2022 Vote Count, available here.

Ballots will begin to be mailed on January 12, 2023, and must be received back at the U.S. Post Office in Dayton, Ohio by February 28, 2023, in order to be counted. The vote count will commence on March 1, 2023.

The Monitor’s website (www.uawmonitor.com/elections) includes all forms for the 2022 Election and 2023 Run-Off Election, as well as question and answer documents and other information. The Monitor’s website will continue to be updated with additional information as the Run-Off Election approaches.

2021 REFERENDUM

The Consent Decree required the UAW to hold a secret ballot Referendum in which the UAW membership would vote on whether to keep the preexisting method for electing members to the International Executive Board (“IEB”) in which local union delegates to the UAW’s Constitutional Convention voted for IEB members, or whether the method should be changed to a direct election by which each UAW member shall directly elect the members of the IEB.

REFERENDUM RESULTS: On December 2, 2021, the 2021 Referendum vote count was completed. Over 1,030,000 UAW members who were eligible to vote in the referendum received a ballot. Out of the total eligible ballots issued to UAW members, a total of 140,586 votes were cast and counted, where 89,615 members voted for the direct voting system (63.7%), while 50,971 members voted for the delegate voting system (36.3%). Thus, the direct voting system prevailed. The Monitor prepared a Referendum Report summarizing the Referendum process and result and provided it to the Department of Labor’s Office of Labor Management Standards (OLMS) for approval on January 7, 2022. On January 19, 2022, OLMS endorsed the Monitor’s Referendum Report, and on January 31, 2022, the Court granted the Monitor’s Unopposed Motion for Approval of Referendum Results. CONSTITUTIONAL AMENDMENTS: Delegates to the 2022 UAW Constitutional Convention, held from July 25-28, 2022, amended the UAW Constitution to affirm the direct election principle, consistent with the Referendum results. The amendments are available on the Monitor’s website at www.uawmonitor.com/elections.
